Following Shooting, Miami Cops Grab Cell Phones at Gunpoint, Destroy Them

Miami Beach police did their best to destroy a citizen video that shows them shooting a man to death in a hail of bullets Memorial Day.

First, police pointed their guns at the man who shot the video, according to a Miami Herald interview with the videographer.

Then they ordered the man and his girlfriend out the car and threw them down to the ground, yelling "you want to be fucking paparazzi?"

Then they snatched the cell phone from his hand and slammed it to the ground before stomping on it. Then they placed the smashed phone in the videographer's back pocket as he was laying down on the ground.

And finally, they took him to a mobile command center where they snapped his photo and demanded the phone again, then took him to police headquarters where they conducted a recorded interview with him before releasing him.

But what they didn't know was that Narces Benoit had removed the SIM card and hid it in his mouth, which means the video survived.

Benoit showed the video to Miami Herald reporters on Thursday, who described it in their article.

The three-minute video captured on Narces Benoit's HTC EVO phone begins as officers crowd around the east side of Herisse's car with guns drawn. Roughly 15 seconds into the video, officers open fire.

Benoit filmed the incident from the sidewalk on the northeast corner of 13th Street and Collins Avenue, close enough to see some officers' faces and individual muzzle flashes.

Shortly after the gunfire ends, an officer points at Benoit and police can be heard yelling for him to turn off the camera. The voices are muffled at times. The 35-year-old car stereo technician drops his hand with the camera and hurries back to his Ford Expedition parked further east on 13th Street.

The video shows Benoit get into the car, where his girlfriend, Ericka Davis, sat in the driver's seat. He raises his camera and an officer is seen appearing on the driver's side with his gun drawn, pointed at them.

The video ends as more officers are heard yelling expletives, telling the couple to turn the video off and get out of the car.

"They put guns to our heads and threw us on the ground," Davis said.

Benoit has not posted it on Youtube because he is asking to be compensated. But it sounds as if he won't have much trouble getting compensated through a settlement with the police department.

However, he first must post the video for the world to see.

Benoit and his girlfriend also said police smashed several phones from other witnesses, so hopefully they were able to recover the videos as well.

The new details emerged a day after police announced they had found a gun in the car they had shot up.

It took police two-and-a-half days to find the gun in the Hyundai but they still haven't determined if it was discharged that night.

For all we know, it could have been locked away in the trunk of the car.

Four innocent bystanders were shot during that shooting, most likely from police bullets.

Also, an hour after that shooting, another officer shot at a man who she believed was driving towards her. But he turned out to be allegedly drunk, which is why he was driving erratically and eventually into a police cruiser.

IS THIS UNBELIEVABLE STUPIDITY OR MURDER?
 
 
They broke in.
There was an eight seconds pause.
THEN there was a volley of gun fire.
After that volley of gun fire had stopped, someone fired one more round. Why?
Was that an additional shot to make sure that Jose Guerena was dead?
If anyone has any evidence to show that this was not a murder, that evidence should be made public.
If there has been any investigation to determine whether or not anyone had a MOTIVE to kill Jose Guerena the findings of that investigation should be made public.
The video, that is above,  can be viewed and compared to the statements of those who killed Jose Guerena.
The SWAT officers who killed Jose Guerena claim that when they opened the door, they saw a man appear in the hallway holding a rifle. The officers claim that they saw muzzle flashes from that gun.
 
It has been determined that Jose Guerena's rifle was on safety and had not been fired.
 
The "evidence" collected from Jose Guerena's home include guns, ammunition, vehicles, cash, documents, and cellphones; but NO DRUGS. No arrests have been made.
 
Does drug abuse do anything that is worse than this?
 
It would be interesting to learn how the guns, ammunition, vehicles, cash, documents, and cellphones, collected from Jose Guerena's home, are different from those that might be found in any other home.  Jose Guerena's wife and young son were in the home but they were not shot.
 
Officer Hector Iglecias, told detectives that he fired because he saw muzzle flashes from Guerena's rifle.
 
Iglecias said right after the shooting "I get this slight glimpse to the left, which is kind of like a living room area".
 
Deputy Kenneth Walsh was the officer who gave the commands. Another SWAT team member, Deputy Christopher Garcia, told investigators he heard Guerena yell something as he came toward the SWAT team holding the rifle. Garcia admits firing on Jose Guerena.

Supporters Rally for Iraq War Veteran Killed by SWAT Team

TUCSON, Ariz. - Jose Guerena was killed by Pima County Sheriff's deputies as they searched his home. Initially, officers said he fired at them first, but later learned he never pulled the trigger.
 
Generally, law enforcement agencies use SWAT teams to serve search warrants if they believe the homeowner is armed.
 
Guerena's supporters say that policy puts homeowners who are trained officers at risk and in this case, it cost a man his life.
 
Oath Keepers, a group dedicated to defending the U.S. Constitution, gathered at Purple Heart Park in Tucson Monday. They rallied in honor of Guerena, a U.S. Marine Corps veteran of the Iraq War.
 
"It's tragic..it should have never happened," said Ray Epps.
 
But Guerena didn't die on the battlefield. He was killed at his home near Tucson as deputies served a search warrant on May 5.

Guerena was shot 60 times. He was suspected of being a drug trafficker, but no drugs were found. He was armed, but no shots were fired from the house.
 
"To serve a search warrant in this way is unreasonable. I can't imaging a more unreasonable search than one that kills you, so this should not have happened," said Stewart Rhodes.
 
Oath Keepers are taking a stand against using SWAT to serve simple search warrants on trained officers or gun owners who have no criminal record.
 
"I don't see any law enforcement officer, any peace officer, I don't see anybody who has been trained any differently," said Epps.
 
"Were not talking about a hostage situation or barricade suspect or a refugee from the law, we're talking about serving a search warrant on a young two-tour Iraq veteran Marine who had a totally clean record," said Rhodes. "He had like four traffic tickets, that's it."
 
The Pima County Sheriff's Department will not comment on this case until the investigation is complete.
 
Guerena leaves behind a wife, two children and a large extended family.

The "straw grabbing" contrivance is now to claim that he blocked traffic. The jack boots chose to block traffic by illegally detaining a law abiding citizen. Anderson just wanted to leave, but he was not allowed to do so.
 
First they tortured him for refusing to answer questions. THEN they told him that he had the right to remain silent. How can there be a duty to answer questions if there is a right to remain silent?
His rights did not just appear when they advised him of them. HE ALREADY KNEW that he had the right to remain silent, and he did so.
They claimed that a DOG gave them "probable cause", and then they claimed that "probable cause" gave them the right to search. "Probable cause" is not the right to search. "Probable cause" is the right to ASK a judge for a search warrant:
